Surrogate pregnancy is the process by which women volunteer to bear and deliver a child for someone else in lieu of a fixed amount of consideration. Many people who have problems in having a child, especially when women face problems in conceiving they take the help of surrogate mothers. The process of surrogate pregnancy involves certain amount of risk. There are also complex ethical factors that need to be considered while making a contract for surrogate mothers.

Many jurisdictions do not recognize surrogate pregnancy; hence there is no specific legal restriction or laws established for surrogacy. It is the general practice that a surrogate mother; though is the biological mother of the child will not be the child’s legal custodian. It is a fact in the course of pregnancy the mother develops an emotional attachment with the child, but she shall not be liable for the child, after delivery usually the social parents adopt the child from the surrogate mother and become parents legally. There is always a question as to what compensation the surrogate mother receives whether it covers all the expenses or not. We cannot ignore that the child born also has certain rights to know the mother’s identity in the future.
